In establishing an account with FrankeFoodservice Systems, Customer agrees to the following terms:
- If account becomes delinquent (beyondinvoice terms), Franke Foodservice Systems reserves the right to placeaccount on hold until account balance is made current.
- Customer hereby appoints FrankeFoodservice Systems as Customer's attorney-in-fact to execute on behalfof Customer any financing statement or other documents required byFranke Foodservice Systems to perfect or enforce its security interestin the event of a default by Customer of any of its obligations toFranke Foodservice Systems. Franke Foodservice Systems shall have therights of a secured party under the uniform commercial code including,but not limited to, the right to retake possession of the merchandiseupon any default by Customer. The security interest will be satisfiedand Customer shall acquire title to the merchandise upon payment toFranke Foodservice Systems of the full amount of the purchase price andall applicable taxes.
